Business Law and Corporate Law

Real Estate Law

The ACQUISITION of real estate is a significant investment. In the context of the notarization of such contracts, which is required by statutory law, we take care on behalf of both the Seller and the Buyer that the drafting of the contract is well-balanced and protects all parties to the contract during the execution of the contract. We attach great importance to explaining the set of agreements to you – agreements are sometimes not easy to understand, albeit essential – and to point out possible problems to you at an early stage and to recommend appropriate solutions.

With respect to PROPERTY DEVELOPER CONTRACTS, whereupon the Seller in his capacity as the property developer sells, in addition to the plot of land, a building erected by the Seller, there exists a need for special provisions. It goes without saying that we take care that the statutory provisions concerning consumers are being complied with.

Are you thinking about transferring real estate to your children or other persons who are close to you? Please do contact us. Law of Succession

It is advisable for everyone to arrange for the succession in property rights in the event of his or her death. Are you familiar with the rules of intestate succession in consideration of the European Regulation on successions? We will illustrate in detail the legal consequences which occur with respect to your family circumstances in the event of your demise. After a demise, a correction of the oftentimes undesirable intestate succession is extremely hard to achieve – not to mention the costs this involves. Please do not rely on the statutory provisions without having evaluated your options first, but rather seize the opportunity to devise your last will.

In our consultation meeting, we are there for you to explain the options including the inheritance tax-related consequences. This includes, in particular, the advantages and disadvantages of the various forms of testamentary dispositions. Please never underestimate the difficulties of phrasing your last will unambiguously . Are you familiar with the difference between an appointment of heirs, a legacy, and a testamentary burden? Or of the risks of a permanent obligation with regard to a joint will or a contract of inheritance?

Family Law

Spouses are entitled to enter into a PRENUPTIAL AGREEMENT before and also during their marriage. With respect to the possibility of a divorce of a marriage, it would be advisable to seek advice from us about the legal and economic consequences of a marriage. The same applies to CIVIL PARTNERSHIPS. It may seem a bit unromantic, but due to the significant legal consequences, it is only sensible to seek advice about the possibilities of a prenuptial agreement for a marriage or for a civil partnership. We will be happy to explain to you the three core areas of interest, namely, the matrimonial property regime, maintenance, and the equalization of pension rights.

If you are living in a non-marital partnership, it is likewise advisable to think about the legal and economic consequences of a separation. This applies in particular in the event of a joint acquisition or financing of real estate.

In the event of a separation, we are here to provide advice to you with respect to a bespoke out-of-court divorce settlement. In order to avoid any disputes, we attach importance to provide well-balanced advice to both parties. Based on this, our long-time experience enables us to develop settlement which does justice to the conflicting interests. In a divorce settlement, it is possible to provide for all substantial consequences, in particular, the equalization of accrued gains under matrimonial property law, as well as any questions relating to maintenance. Thus, it is possible to significantly reduce the costs of a divorce. Moreover, a divorce settlement usually saves a lot of worry and stress.

Enduring Power of Attorney and Living Will

Many citizens are unaware of what happens when they cannot arrange their affairs themselves anymore due to an accident or a severe illness. Did you happen to know that the courts may and/or must decree a custodianship in that case? Usually, strangers are deployed as custodians in such cases. Married people oftentimes wrongly assume that the fact that they are married suffices in order to act on behalf of their spouse. However, even your spouse is not entitled to act effectively for you without a corresponding power of attorney. The same applies to children.

In the event that no power of attorney has been granted, the court must decree a custodianship for the affected person. The judicial control involved by this is usually deemed to be exhausting and also expensive. It is therefore advisable for you to take matters into your own hands and to issue an ENDURING POWER OF ATTORNEY to one or more persons you confide in. Avoid making mistakes and seek advice from us. We will be happy to explain to you where to keep the power of attorney and where to have it registered.

An enduring power of attorney is often combined with a HEALTH CARE PROXY. Moreover, a LIVING WILL can be also created at the same time. This way, you can determine your requests concerning the modalities of medical treatment.

Dr. Sibylle Wenner was appointed as notary in Munich in 2005 as the successor of Dr. Helmut Stummer, notary. She completed her legal studies in Bayreuth and Munich. In addition to her doctorate degree (Dr. jur.), she graduated from University of London (LSE, London School of Economics and Political Sciences), where she was awarded the title Master of Laws (LL.M.).

Dr. Markus Riemenschneider completed his legal studies at the universities of Freiburg im Breisgau and Bayreuth and was awarded his doctorate degree in tax law from the University of Bonn. In 2001, he was appointed as notary, his first office being in Landsberg am Lech. Since March 2010, he has his office in Munich as the successor of Dr. Friedrich Schalkhaußer, notary.

Dr. Riemenschneider regularly publishes professional publications as well as reference books on corporate law and on real estate law.
